Schaefer Opposes U.S. Supreme Court Action on DOMA

Matt Schaefer4TYLER (Staff/AP) — Rep. Matt Schaefer, R-Tyler, disagrees with U.S. Supreme Court action Wednesday on the Federal Defense of Marriage Act. Schaefer said, “The Supreme Court ruling cuts away the power of the people to govern themselves, and increases the Court’s own power in a way our Founders never intended. This is a terrible blow to the Constitution. The history of mankind has proven that the biblical definition of marriage between one man and one woman is the best way to build a secure family. The Supreme Court has departed from that deeply rooted tradition. However, I will not move one inch on defending marriage in Texas. I will always oppose same-sex marriage. We must prepare for fierce assaults on our conservative values.”

The Supreme Court issued a pair of significant but incomplete victories for supporters of gay marriage. In one 5-to-4 ruling, the court struck down a provision of a federal law that denied federal benefits to gay married couples. The provision of the Defense of Marriage Act kept legally-married same-sex couples from receiving tax, health and pension benefits that go to married couples of the opposite sex.

In the other, also a 5-to-4 ruling, the justices said nothing at all about same-sex marriage itself. But they left in place a finding by a trial court that California’s Proposition 8 — banning same-sex marriage — is unconstitutional. That’s an outcome that will probably allow California officials to order the resumption of same-sex weddings in the state in about a month.
