Man Given Deferred Adjudication on Murder Charge Gets Re-Arrested

rearrestedmugLONGVIEW — A Longview man who was sentenced in July 2011 to 10 years deferred adjudication after being charged with murder in Wood County has been arrested again in connection with the crime. That’s according to KETK and the Longview News-Journal. Ty Jordan Evans, 22, and his brother Damaracus Hearn 20 at the time of the murder crime were accused of killing 24-year-old Annamarie Moore during a daytime drive-by shooting in Winnsboro. Evans faced two trials, one in January 2011 and one in May. Both ended in a mistrial after neither jury could come to a decision. He pleaded guilty and received the deferred adjudication two months after the second mistrial. Now Longview police spokeswoman Kristie Brian has said Evans was arrested sometime after 2 p.m. Friday during a traffic stop at the intersection of Tryon and Eastman roads.

According to Gregg County judicial records, Evans was arrested due to a motion to adjudicate guilt on the outstanding murder charge and held in the Gregg County Jail on a $75,000 bond. Wood County Sheriffs Office dispatchers said they were not immediately able to discuss Evans case, adding that. According to Wood County judicial records, the motion to adjudicate guilt was filed last Tuesday.

A motion to adjudicate guilt typically asks a court to revoke the deferred adjudication because the subject has violated the terms of the deferred probation. Deferred adjudication means the judge accepts a defendants plea but defers finding the person guilty until the end of a probationary period when, if the defendant completes the probation successfully, the judge dismisses the case instead of convicting the suspect. Wood County records also show that a warrant to arrest Evans, which was not immediately available Saturday, was filed Wednesday in connection with the case.

Neither the original terms of the deferred adjudication nor the reason for the motion to adjudicate guilt was immediately available; however, Evans was arrested earlier this month by Gregg County sheriffs deputies on a charge of public intoxication.
